A Florida man who was allegedly injured on the job last year has filed a workplace injury lawsuit against an Orlando carpet foam company.
The Orlando Sentinel reports that the lawsuit, filed on behalf of 44-year-old Edgardo Toucet Echevarria, accuses Future Foam Carpet Cushion of negligence after one of the company's peeler machines sliced off his penis after he removed foam from the machine with a steel blade.
According to the news provider, Echevarria, who was a contract employee of Spartan Staffing at the time, claims that Future Foam did not properly train him on the machine and that workers had improperly removed a protective guard crucial to the safety of the equipment.
The lawsuit also reportedly names the company that makes the peeler machine, Baumer of America, as a defendant, and is seeking more than $15,000 for disfigurement, loss of capacity, loss of earnings as well as medical and other expenses.
The Occupational Safety and Health Administration has reportedly cited the company with 10 violations in connection with the accident. The federal safety agency has recommended that Future Foam pay $42,000 in fines. The company is reportedly contesting the decision.
